1. Scope
This Refund Policy applies to fees paid to Kun Ding for custom development services and any pre-paid retainers. Refunds are governed by this policy together with the terms of your signed Statement of Work ("SOW") and our Terms of Service.
2. When refunds apply
You are eligible for a refund of unearned fees in the following cases:
- Pre-kickoff cancellation: You may request cancellation within 48 hours of signing the SOW. The refund amount is negotiated in good faith between the parties, after deducting any work already performed (including discovery, scoping, and resource allocation) and direct costs incurred. No cancellation refund is available beyond this 48-hour window.
- Material breach by us: We materially breach the SOW and fail to cure within 30 days of written notice. Unearned portions of pre-paid fees are refunded.
- Service unavailable: We are unable to deliver a contracted service due to circumstances within our control. Unearned portions are refunded.
3. Refund window
Refund requests must be submitted in writing within 7 calendar days of the event giving rise to the request. Requests received after this window will not be accepted, without exception.
4. How to request a refund
- Email wava2980@gmail.com with subject "Refund Request — [Project Name]".
- Include the original invoice number, date of payment, amount, and the reason for the request.
- We will acknowledge receipt within 3 business days.
- We may request additional information to evaluate the request.
5. Processing timeline
Approved refunds are processed within 10 business days of approval. Refunds are issued to the original payment method where possible. Bank or card-network processing may add additional time.
6. Non-refundable items
The following are non-refundable:
- Fees for work already completed and accepted.
- Third-party costs we have paid on your behalf (e.g., licenses, hosting, domains, design assets).
- Discovery, scoping, and design work that has been delivered.
- Hours billed for an active retainer that has been used.
- Project cancellations made by you after development has begun, except where covered under Project Cancellation.
7. Project cancellation
You may cancel an engagement at any time with written notice. In the event of cancellation:
- You remain responsible for all fees earned through the date of cancellation.
- You will be invoiced for any work in progress as of the cancellation date.
- Any unearned portion of pre-paid fees will be refunded under this policy.
- Deliverables will be handed over upon settlement of outstanding amounts.
8. Disputes
If you disagree with a refund decision, please respond to our determination within 14 days. We will review the matter in good faith. Disputes that cannot be resolved through direct discussion are subject to the dispute-resolution process in your SOW or our Master Services Agreement.
Initiating a chargeback with your card issuer without first contacting us is a breach of these terms and may result in suspension of services and additional fees.
